Creator & Prohibited Content Policy

This Policy governs content that may be uploaded, minted, listed, or sold on Digital Collectibles Marketplace by creators, sellers, and users.

1. Creator Responsibility

Any person minting or listing an NFT on Digital Collectibles Marketplace ("Creator") represents and warrants that:

They are the original creator or rights holder of the content uploaded, or have obtained all necessary licences, permissions, and consents from the rights holder(s) to mint and sell that content as an NFT;
The content does not infringe any third-party intellectual property rights, including copyright, trademark, design rights, trade secrets, or personality rights;
The content complies with all applicable laws and regulations in the Creator's jurisdiction and in the jurisdictions where the NFT may be sold;
The content does not fall into any category of Prohibited Content set out in Section 3 of this Policy.

By submitting content for minting, the Creator accepts full responsibility for compliance with this Policy.

2. Rights Acknowledgement (Required Before Minting)

Before minting any NFT, Creators must confirm the following declaration:

"I confirm that I own or hold the necessary rights, licences, or permissions to the content I am uploading. I confirm that this content does not infringe any third-party intellectual property rights and does not violate the Creator & Prohibited Content Policy of Digital Collectibles Marketplace."

Submitting content for minting constitutes acceptance of this declaration. False or misleading declarations may result in listing removal, account suspension, and legal liability.

3. Prohibited Content

The following categories of content are strictly prohibited on Digital Collectibles Marketplace. Listings containing prohibited content will be removed without notice and may result in permanent suspension:

3.1 Copyright & IP Infringement
Content that reproduces, copies, or closely imitates artwork, characters, logos, brands, photographs, or other creative works owned by third parties without authorisation. This includes fan art sold commercially without a licence, official brand assets, and copyrighted media.

3.2 Adult & Explicit Content
Sexually explicit, pornographic, or adult-only material of any kind.

3.3 Violent & Hateful Content
Content that promotes, glorifies, or depicts extreme violence, hate speech, discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics, terrorist or extremist content, or content that incites harm.

3.4 Illegal or Regulated Items
NFTs purporting to represent real-world regulated goods (firearms, drugs, controlled substances), NFTs designed to facilitate money laundering, fraud, or sanctions evasion, or content that is illegal in the UK or the user's jurisdiction.

3.5 Financial Instruments & Securities
NFTs structured as securities, investment contracts, revenue-sharing tokens, or any instruments that may constitute regulated financial products under applicable law without appropriate authorisation.

3.6 Gambling & Games of Chance
NFTs whose primary utility is to participate in lotteries, games of chance, or gambling activities unless the Creator holds appropriate gambling licences in relevant jurisdictions.

3.7 Impersonation & Deception
Content designed to impersonate other creators, celebrities, brands, or official collections. NFTs falsely claiming affiliation, endorsement, or provenance from real-world artists or organisations.

3.8 Sanctions & Restricted Persons
Content created by or for the benefit of sanctioned individuals or entities, or content designed to circumvent economic sanctions or export controls.

3.9 Personal Data & Privacy Violations
Content that includes personally identifiable information of real individuals without their consent, including private images, documents, or contact details.

4. Moderation & Enforcement

Digital Collectibles Marketplace reserves the right to:

Review any listed NFT or uploaded content at any time;
Remove listings that violate this Policy without prior notice;
Suspend or permanently ban accounts responsible for repeated or serious violations;
Report content to law enforcement or regulatory bodies where required by law;
Withhold or reverse payouts where a listing is found to be in breach of this Policy.

Creators may appeal moderation decisions by contacting legal@digitalcollectiblesmarketplace.com within 14 days of notification.

5. DMCA & Copyright Complaints

If you believe an NFT listed on this platform infringes your copyright or other intellectual property rights, please submit a written complaint to:

Your complaint must include: (a) identification of the protected work; (b) identification of the infringing content and its location on the platform; (c) your contact details; (d) a statement of good faith belief; and (e) a statement of accuracy under penalty of perjury.

We will investigate and respond within 5 business days.

6. Liability

Digital Collectibles Marketplace does not pre-screen all content uploaded by Creators. Creators bear sole responsibility for the legality, authenticity, and compliance of their content. Digital Collectibles Marketplace shall not be liable for any third-party claims arising from Creator-uploaded content, including claims of copyright infringement, defamation, or privacy violation.

7. Updates to This Policy

We may update this Policy from time to time. The updated version will be published at digitalcollectiblesmarketplace.com/creator-policy with a revised Last Updated date. Continued use of the platform after an update constitutes acceptance of the revised Policy.
